New Jersey legalized recreational cannabis in 2021 and the market has grown to nearly $1 billion in annual sales. Adults 21 and older can legally purchase and possess up to six ounces of cannabis — but growing your own plants at home is still illegal. New Jersey is one of only a handful of states with legal adult-use cannabis that still prohibits home cultivation. Hemp cultivation is legal with a license from the New Jersey Department of Agriculture (NJDA), with one of the lower application fees in the country. What any New Jersey resident can do right now is purchase cannabis seeds, including high-THC varieties, for collecting and to be prepared if and when New Jersey adds home grow rights. Can You Grow Cannabis at Home in New Jersey?
No. Despite being a fully legal adult-use state, New Jersey explicitly did not include home cultivation rights when it legalized cannabis through the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMM Act) in February 2021. The law legalized possession of up to six ounces for adults 21 and older, but growing plants at home remained a criminal offense.
This makes New Jersey one of only a small number of legalization states — alongside Delaware, Illinois, and Washington — that prohibits home cultivation. All but three of the other 23 legalization states allow some form of home cultivation.
Under current New Jersey law, cultivation of one ounce to less than five pounds of cannabis is a third-degree crime carrying three to five years in prison and fines up to $25,000. This applies equally to recreational users and registered medical patients.
Hemp Is Legal to Grow in New Jersey With a License
Hemp — cannabis with no more than 0.3% delta-9 THC by dry weight — is legal to cultivate in New Jersey under a grower license issued by the New Jersey Department of Agriculture (NJDA). New Jersey’s hemp program operates under the NJDA’s USDA-approved state hemp plan and has been accepting licensed growers since 2020.
Applications are submitted to NJDA either by mail to PO Box 330, Trenton, NJ 08625, or by email to NJHemp@ag.nj.gov. Virtual submissions are encouraged for faster processing.
How to Get a New Jersey Hemp Grower License
- Obtain a New Jersey State Police background check before submitting your application. The background check printout must be attached to the application at submission.
- Download and complete the current NJDA Hemp Grower License Application from nj.gov/agriculture. All information must be typed, accurate, and complete — NJDA does not accept responsibility for missing information due to formatting errors, and incomplete applications may be removed from consideration.
- Prepare GPS coordinate maps for each proposed cultivation site, including a site security plan. Each site registered under your license will be subject to inspection by NJDA staff, New Jersey State Police, and other law enforcement.
- Submit the completed application, background check, and two separate checks or money orders payable to the New Jersey Department of Agriculture — one for the $50 non-refundable application fee and one for the license fee ($300 plus $15 per acre).
- Once NJDA receives your application, the department will review it and conduct an inspection of the proposed cultivation or processing site. If approved, NJDA issues your license, which is valid for one year.
- Register your grow sites with your local USDA Farm Service Agency (FSA) office for annual acreage reporting.

What the License Requires
Once licensed:
Pre-harvest sampling. All hemp lots must be tested before harvest to confirm THC compliance. New Jersey uses USDA-certified sampling protocols. Crops testing above 0.3% delta-9 THC must be destroyed.
Site access. By accepting a license, you agree that NJDA staff, New Jersey State Police, and other federal, state, and local law enforcement may enter any premises where hemp or cannabis plants are located. Refusing entry is a violation of the hemp program and may result in suspension or revocation.
Annual renewal. Licenses are valid for one year and must be renewed annually.
Acreage and harvest reporting. Annual reports covering planting, harvest, and disposition must be submitted to NJDA and to your local FSA office.
Costs to Know Before You Apply
Application fee: $50 non-refundable — one of the lowest in the country.
License fee: $300 base plus $15 per acre of intended cultivation area. A one-acre grow costs $315. A 10-acre grow costs $450. A 100-acre grow costs $1,800.
Background check: New Jersey State Police. Modest cost; required before submission.
Pre-harvest testing: You pay the sampling agent and testing laboratory directly.
New Jersey’s fee structure is among the most accessible in the Northeast for small to mid-size operations. The per-acre scaling keeps costs reasonable across a range of operation sizes.
Home Grow Bills Pending in New Jersey
New Jersey’s legislature has seen multiple home cultivation bills introduced in recent sessions, none of which have passed either chamber. Here is where things stand as of May 2026:
S2564 — Adult-use home cultivation (pending). This bill would allow adults 21 and older to grow or possess up to six marijuana plants for personal recreational use, with a 12-plant household cap. It has been active in the Senate Judiciary Committee but has not advanced to a floor vote.
A1674 and S1758 — Medical patient home cultivation (pending). These companion bills would allow registered medical cannabis patients and their caregivers to cultivate up to four mature and four immature plants for personal therapeutic use. Medical-only home grow bills have historically had slightly more political traction than adult-use bills in New Jersey, though neither has reached a committee vote in 2026.
What’s blocking progress. Several factors have kept home grow bills stalled. Assembly Health Committee Chair Herb Conaway has consistently blocked bills from advancing. Dispensary industry interests have lobbied against home cultivation, which would reduce retail sales. Former Governor Murphy neither endorsed nor opposed home grow during his tenure, leaving the issue politically unresolved.
The 2025 gubernatorial election. Governor Murphy’s term ended in January 2026, and a new governor took office following the November 2025 election. As of early 2025, most gubernatorial candidates from both parties had voiced support for legalizing home cannabis cultivation. The new governor’s position on pending home grow legislation will be a significant factor in whether any of these bills advances in 2026.
Public pressure growing. The Cannabis Regulatory Commission received public comments in its February 2026 meeting explicitly calling for home cultivation rights, citing Maine’s framework as a model. New Jersey’s average retail price of over $30 per gram — among the highest in the country — is driving consumers to neighboring states and the illicit market, strengthening the practical case for home cultivation.
New Jersey’s Adult-Use and Medical Cannabis Programs
Adult-use. New Jersey voters approved cannabis legalization in November 2020 by more than two-thirds. The CREAMM Act was signed in February 2021, and retail adult-use sales began in April 2022. Adults 21 and older can legally possess up to six ounces of cannabis flower or equivalent. The Cannabis Regulatory Commission (CRC) oversees all licensing. Retail sales are taxed at the standard 6.625% state sales tax plus a Social Equity Excise Fee and up to 2% local municipal tax. Localities can opt out of allowing cannabis retail businesses.
Medical. New Jersey’s Compassionate Use Medical Marijuana Act was signed in January 2010, making it one of the early East Coast medical programs. Registered patients can purchase up to three ounces per month from licensed Alternative Treatment Centers or dispensaries. Medical cannabis is tax-exempt. Home cultivation is not permitted for patients under current law.
Both programs prohibit public consumption and consumption in motor vehicles.
Outdoor Growing in New Jersey
New Jersey spans USDA hardiness zones 6a through 7b, with the northern counties including the Skylands region in zone 6a and the southern coastal areas and Cape May County reaching zones 7a and 7b. The outdoor growing season runs from mid-May through October in most of the state.
New Jersey’s moderate Mid-Atlantic climate is well-suited to outdoor hemp cultivation. The state’s agricultural heartland in the southern coastal plain — Burlington, Cumberland, and Salem counties — has some of the most productive farmland in the region and a longer frost-free window than the north.
Photoperiod hemp strains typically reach maturity in late September through mid-October across New Jersey. Autoflowering hemp strains — finishing in 70 to 90 days regardless of light cycle — can give licensed growers in the northern counties more flexibility against early frost, or allow growers statewide to plan a harvest window that avoids late-season weather uncertainty.

Penalties for Growing Without a License
Under current New Jersey law, home cultivation is treated as manufacturing — a serious criminal offense regardless of the amount:
Cultivation of one ounce to less than five pounds is a third-degree crime carrying three to five years in prison and fines up to $25,000. Cultivation of five pounds or more escalates to a second-degree crime with five to ten years in prison and fines up to $150,000. Cultivation of 25 pounds or more is a first-degree crime with 10 to 20 years in prison and fines up to $300,000.
These penalties apply to everyone — recreational users and registered medical patients alike. There is no personal use exception in current law.
Growing hemp without an NJDA license is also illegal under New Jersey state law.
