This agreement is made between TH LLC and the purchaser (“RECIPIENT”). By placing an order, RECIPIENT acknowledges and agrees to the following terms regarding the transfer of plant materials (“MATERIAL”).

1. Legal Compliance

MATERIAL consists of hemp seeds legally defined under federal law as containing less than 0.3 percent delta-9 THC by dry weight. RECIPIENT affirms that they are legally eligible under their local and state laws to acquire and possess such MATERIAL. Any cultivation information provided by TH LLC is intended only for adults in regions where cultivation is lawful.

2. Permitted Use Under Federal Law

RECIPIENT acknowledges that the transfer and receipt of MATERIAL is permitted under the 2018 Farm Bill and agrees to handle the MATERIAL in accordance with applicable laws and regulations.

3. Assumption of Risk and Liability

RECIPIENT assumes all liability for any outcomes arising from the use, storage, germination, growth, or disposal of MATERIAL. TH LLC shall not be liable to RECIPIENT or any third party for any claim, loss, damage, or demand related to RECIPIENT’s use or handling of MATERIAL. RECIPIENT agrees to indemnify and hold harmless TH LLC from any claims, attorney fees, or costs arising out of RECIPIENT’s use or misuse of MATERIAL.

4. No Warranty or Representation

Descriptions, illustrations, and information provided by TH LLC regarding genetics, performance, growth characteristics, or outcomes are general in nature and do not constitute a warranty. MATERIAL may perform differently based on environmental, genetic, or management conditions. TH LLC provides no warranty, express or implied, regarding the appearance, vigor, cannabinoid expression, or performance of any plants grown from MATERIAL.

5. Plant Health Disclaimer

While TH LLC believes the MATERIAL to be free of latent defects, plant diseases may be transmitted through various natural or human means. No warranty is made that MATERIAL is free from disease, pests, or defects.

6. Germination Guarantee

TH LLC stands behind its seeds. If RECIPIENT follows the germination instructions at trianglehemp.com/germination-guide exactly and the MATERIAL fails to germinate, TH LLC will send replacement seeds at no charge. Because seeds are a natural product, germination is never 100% guaranteed — but TH LLC’s process has been refined over 10+ years of commercial cultivation and is designed to give RECIPIENT the best possible start.

To be eligible for a replacement, ALL of the following conditions must be met:

1. Follow the method on the germination guide page exactly as written — paper towel method for feminized/photoperiod seeds, direct pot for autoflowers.
2. The full 14 days must have passed since the soak date without germination.
3. The order must have been placed within the last 60 days — seeds purchased before that window have unknown storage history and are not eligible.
4. Photo documentation is required: one photo at the soak step, one of the paper towel or pot setup, and one of the ungerminated seeds at day 14.
5. Seeds planted directly outside are not eligible.

To submit a claim, RECIPIENT must contact TH LLC at (919) 410-6945 or support@trianglehemp.com with their order number and required photos. Claims submitted without photo documentation cannot be processed.

By placing an order, RECIPIENT certifies that they have read, understand, and agree to abide by this Agreement.
