Can You Grow Cannabis at Home in Oklahoma in 2026?

A Guide to Oklahoma Home Grow Laws

Last updated: March 2026

Oklahoma home grow laws allow registered medical marijuana patients to cultivate up to six mature plants and six seedling plants at home. Oklahoma voters approved medical cannabis through State Question 788 in 2018, and home cultivation rights were included from the start. The program has one of the most accessible application processes in the country, with no qualifying conditions list and a straightforward online application. Here’s what you need to know.

Who Can Grow at Home in Oklahoma

Any Oklahoma resident who holds a valid OMMA medical marijuana patient license can grow at home. Unlike many states, Oklahoma does not maintain a list of qualifying conditions. Any Oklahoma physician in good standing can recommend medical cannabis for a patient. That makes Oklahoma one of the most accessible medical cannabis programs in the country.

You must be 18 or older to apply. Patients under 18 can qualify with applications signed by two physicians and a parent or legal guardian.

How to Get Your Oklahoma Medical Marijuana License

Oklahoma’s application process is entirely online and straightforward.

Step 1: Get a physician recommendation Schedule an appointment with any Oklahoma-licensed physician, osteopathic physician, or podiatric physician in good standing with their respective state licensing board. The physician will sign your application certifying that you are their patient and that medical cannabis may benefit you. Telehealth appointments are widely available from services that specialize in Oklahoma medical cannabis evaluations.

Step 2: Apply through OMMA Submit your application at oklahoma.gov/omma. You will need:

  • Your signed physician certification
  • A valid Oklahoma photo ID or proof of state residency
  • Payment of the $100 application fee ($20 for patients on Medicaid, Medicare, or SoonerCare)

Licenses are valid for two years. The OMMA issues licenses digitally, and you can begin using your license as soon as it is issued.

How Many Plants You Can Grow

Licensed patients may cultivate:

  • 6 mature plants (harvestable female plants that are flowering)
  • 6 seedling plants (nonflowering plants that have not yet demonstrated signs of flowering)

That gives you up to 12 plants at any one time. The distinction between mature and seedling matters: once a plant begins to flower, it counts toward your mature plant limit. If you are cloning, monitor your plant count to make sure flowering plants don’t push you over the six-mature limit.

You may also legally possess the harvested marijuana from your home grow in addition to your standard possession limits.

Where and How You Can Grow

Oklahoma’s home grow rules are straightforward:

Property ownership or written permission. Your plants must be grown on real property you own, or on property where you have the written permission of the property owner. If you rent, get written permission from your landlord before you plant. A simple email reply confirming permission is sufficient documentation, though a written addendum to your lease is cleaner.

Not visible from the street. Plants cannot be visible from any street adjacent to the property to a person with normal 20/20 vision without any viewing aids. This applies to both sides of the property line. Keep plants screened from public view.

No hazardous extraction on residential property. Oklahoma law expressly prohibits using butane, propane, carbon dioxide, or any potentially hazardous material for extraction at a residential property. Solventless methods are permitted.

Both indoor and outdoor grows are permitted as long as these conditions are met.

What You Can Possess at Home

In addition to your 6 mature plants and their harvested marijuana, a licensed patient can legally possess at their residence:

  • Up to 8 ounces of marijuana
  • Up to 1 ounce of concentrated marijuana
  • Up to 72 ounces of edible marijuana
  • Up to 72 ounces of topical marijuana

These limits apply to all marijuana in your home combined, whether purchased from a dispensary or grown at home.

Caregivers and Cultivation

A licensed caregiver can cultivate on behalf of a homebound medical marijuana patient. Caregivers can serve up to five patients simultaneously, and each patient’s six-mature plus six-seedling limit applies independently. Caregivers cannot charge patients more than the actual costs incurred in cultivating the cannabis, and they cannot use or distribute the cannabis outside the licensed patient relationship.

What About Recreational Home Growing?

Recreational cannabis remains illegal in Oklahoma as of early 2026. Oklahoma voters rejected State Question 820 in March 2023, a recreational legalization initiative that would have included home cultivation rights. A new initiative, State Question 837, was proposed in 2025 by Oklahomans for Responsible Cannabis Action (ORCA), which would allow adults to grow up to 12 plants at home. Advocates were working to collect the required 172,000 signatures to qualify for the 2026 ballot, though new restrictions on the ballot initiative process signed by Governor Stitt in May 2025 have raised the bar for future efforts.

Whether recreational legalization comes through a ballot measure or legislative action, home cultivation rights are expected to be part of any future proposal. We will update this post if and when the law changes.

Frequently Asked Questions

How many plants can I grow with an Oklahoma medical marijuana license?

Up to six mature plants (flowering) and six seedling plants (nonflowering) at any one time, for a total of twelve plants. You may also possess the harvested marijuana from your plants in addition to standard possession limits.

What conditions qualify for an Oklahoma medical marijuana license?

Oklahoma does not maintain a list of qualifying conditions. Any Oklahoma-licensed physician can recommend medical cannabis for a patient they are treating. This makes Oklahoma one of the most accessible medical cannabis programs in the country.

Do I need my landlord’s permission to grow?

Yes, if you rent. Plants must be grown on property you own or on property where you have the written permission of the property owner. Get that permission in writing before you plant.

Can my plants be visible from outside?

No. Plants cannot be visible from any street adjacent to the property to a person with normal 20/20 vision without viewing aids. This applies regardless of whether you are growing indoors or outdoors.

How much does an Oklahoma medical marijuana license cost?

Is recreational home growing likely to become legal in Oklahoma?

Possibly, through a future ballot measure. State Question 837, proposed in 2025, would allow adults to grow up to 12 plants at home if passed. Whether it qualifies for the 2026 ballot depends on signature gathering efforts under new rules that raised the bar for initiatives. We will update this post when the law changes.
