Who Can Grow

Any adult 21 or older may grow cannabis at home in Rhode Island for personal use. No registration or permit is required for recreational home cultivation. Rhode Island legalized adult-use cannabis with the Rhode Island Cannabis Act, signed by Governor Daniel McKee on May 25, 2022 – making Rhode Island the 19th state to end cannabis prohibition for adults.

Home cultivation must comply with security requirements promulgated by the Rhode Island Cannabis Control Commission (CCC), whose rules took effect on May 1, 2025 under RICR Title 560.

Two adults, three adults, or four adults sharing a home all have the same ceiling: three mature plants and three immature plants. Rhode Island’s limit is among the most restrictive in the country for recreational growers, tied with Maryland’s two-plant household cap as among the lowest in this series.


Where You Can Grow

Cultivation must take place within a residence and must comply with the Cannabis Control Commission’s security requirements. Plants must not be visible from a public place.

The CCC’s security requirements effectively require that home grows be conducted indoors, in a locked space that prevents access by unauthorized individuals. Outdoor grows, even behind a fence, are difficult to bring into compliance with the security and visibility requirements as written.

Rhode Island’s approach resembles Maryland’s: the combination of a small plant count, an indoor-favoring security rule, and a visibility prohibition makes a well-secured indoor grow the most straightforward path to compliance.


Security Requirements

The statute at R.I. Gen. Laws § 21-28.11-22 conditions the personal use exemption on compliance with “all security requirements as promulgated by the commission.” The Cannabis Control Commission’s rules under RICR Title 560, effective May 1, 2025, govern the specifics.

In practice, the security rules require that plants be kept in a locked space that is not accessible to persons under 21 and not visible from outside the cultivation space. A locked grow tent, locked grow room, or other secured indoor space satisfies these requirements. An unsecured or publicly visible outdoor area does not.


Renters and Landlords

Rhode Island law allows property owners to restrict or prohibit cannabis cultivation on their property. If you rent, review your lease carefully before starting a grow – a landlord can prohibit cultivation even where state law otherwise permits it.

Get written permission from your landlord before setting up any grow in a rental property. The security and indoor requirements make home growing in rental apartments a practical challenge regardless of what your lease says.


Medical Patient Limits

Registered medical marijuana patients in Rhode Island operate under the Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act and are permitted to grow significantly more than recreational adults:

  • Up to 12 mature plants and 12 immature plants at home
  • Cultivation must take place indoors
  • Each plant must have a state-issued plant tag certificate obtained through the Office of Cannabis Regulation

Greenhouses do not qualify as indoor spaces for medical cannabis cultivation under Rhode Island regulations. All medical patient grows must be in a fully enclosed indoor facility.
