Delaware Cannabis and Hemp Growing Laws: What’s Legal in 2026

Delaware is one of the few states that has fully legalized adult-use cannabis but still does not allow home cultivation. Recreational cannabis has been legal since April 2023, and retail sales launched on August 1, 2025 — but growing your own plants at home remains illegal for everyone, including medical patients. Hemp cultivation is legal with a license from the Delaware Department of Agriculture. What any Delaware resident can do right now is purchase cannabis seeds, including high-THC varieties, for collecting and to be prepared if and when Delaware adds home grow rights to its cannabis laws. Cannabis seeds are legally classified as hemp under the 2018 Farm Bill — the seed itself contains no meaningful THC regardless of what the plant would eventually produce. Can You Grow Cannabis at Home in Delaware?

No — and Delaware’s situation is worth understanding clearly. The state legalized adult-use cannabis in 2023 and launched retail sales in August 2025. Adults 21 and older can legally possess up to one ounce of cannabis flower, 12 grams of concentrate, or products containing up to 750 milligrams of delta-9 THC. But the legalization legislation — House Bills 1 and 2 — did not include home cultivation rights.

Delaware is one of only four states that has legalized recreational cannabis but still prohibits adults from growing their own plants at home. The others are Illinois, New Jersey, and Washington. All cultivation in Delaware is restricted to licensed commercial operations.

Medical patients face the same restriction. Even registered patients must purchase from a licensed compassion center or dispensary — no home grow is permitted under the medical program either.

Possession above the personal use quantity — more than one ounce — is an unclassified misdemeanor. Cultivation without a license is a separate offense.


Hemp Is Legal to Grow in Delaware With a License

Hemp — cannabis with no more than 0.3% delta-9 THC by dry weight — is legal to cultivate in Delaware under a license from the Delaware Department of Agriculture (DDA), Plant Industries Section. Delaware’s hemp program was established by Senate Bill 266 in 2018 and received USDA approval for its state hemp production plan.

Delaware defines hemp as an agricultural commodity and a grain under state law. The DDA issues grower, processor, and handler licenses. Applications for new growers are accepted once per year with a February 1 deadline for the upcoming growing season.

How to Get a Delaware Hemp Grower License

Applications are submitted to the Delaware Department of Agriculture by mail. The process requires:

  1. Request an FBI Criminal History Report online before applying. When submitting your FBI request, include the Delaware Department of Agriculture’s mailing address as the recipient so the report is delivered directly with your application materials.
  2. Complete the Growing Site Registration forms for your cultivation locations — either the outdoor or indoor version. Include maps showing GPS coordinates of all grow sites.
  3. Complete the Producer Application form, designating an Authorized Representative.
  4. Submit all required documentation by mail to the Delaware Department of Agriculture, Plant Industries Section, by the February 1 deadline for new applicants.
  5. Register your grow sites with your local USDA Farm Service Agency (FSA) office for acreage reporting.

New applicants must submit by February 1 each year. Licensed producers must submit renewal applications before their license expiration date. Licenses do not renew automatically.

What the License Requires

Once licensed:

Pre-harvest testing is required. Delaware tests 100% of hemp lots before harvest to confirm THC compliance. Do not harvest before receiving your lab results.

Every location where hemp is present — including storage and drying structures — must be registered with the DDA as a site under your license. Any changes to sites after approval require a site modification request.

Annual reporting covers acreage planted, acreage harvested, and production details. Licenses must be renewed annually.

A licensed producer who negligently violates program rules three times within five years will have their license revoked and be ineligible to produce, handle, or process hemp for five years from the date of the third violation.


Delaware’s Adult-Use Cannabis Program

Delaware legalized adult-use cannabis through House Bill 1 and House Bill 2, passed by the legislature in March 2023 with veto-proof supermajorities. Governor John Carney allowed both bills to become law without his signature in April 2023.

Adult-use retail sales launched on August 1, 2025, initially through existing medical dispensaries (compassion centers) that converted to dual licenses. The Office of the Marijuana Commissioner (OMC) awarded 124 cannabis licenses by lottery in late 2024, including 30 retail licenses, with additional licenses issued in 2025. A 15% excise tax applies to adult-use sales. Medical cannabis purchases remain tax-free.

Adults 21 and older can legally:

  • Possess up to one ounce of cannabis flower
  • Possess up to 12 grams of concentrated cannabis
  • Possess products containing up to 750 milligrams of delta-9 THC
  • Consume on private property

What remains prohibited: home cultivation, public consumption, and driving under the influence.

Municipalities in Delaware have opt-out authority — they can restrict or prohibit cannabis retail businesses within their borders through local ordinance or zoning.


Delaware’s Medical Cannabis Program

Delaware’s Medical Marijuana Act was passed in May 2011, making it one of the earlier East Coast states to establish a medical program. The program is administered by the Delaware Health and Social Services (DHSS) Office of Medical Marijuana.

Qualifying patients of any age with certain debilitating medical conditions can register for a medical marijuana card and purchase from licensed compassion centers. Registered patients can purchase up to 3 ounces of processed cannabis every two weeks and possess up to 6 ounces at a time.

In 2024, HB 285 expanded the program further: physicians can now certify patients for any condition they believe may benefit from cannabis treatment, patients over 65 can self-certify, out-of-state medical cannabis patients have reciprocity, and cards can be issued for up to two or three years.

As with adult-use, home cultivation is not permitted for medical patients.


Outdoor Growing in Delaware

Delaware is a small state that falls primarily in USDA hardiness zones 6b and 7a, with the southern coastal areas touching zone 7b. The outdoor growing season in most of the state runs from mid-May through early October.

Photoperiod hemp strains typically reach maturity in late September through mid-October across Delaware. Autoflowering hemp strains — which finish in 70 to 90 days regardless of light cycle — can be well suited to Delaware’s relatively short growing season, particularly in the northern part of the state.

Penalties for Growing Without a License

Cultivation of cannabis without a commercial license remains illegal in Delaware regardless of whether you are a recreational user or a medical patient. All growing must take place at licensed commercial facilities.

Possession above one ounce is an unclassified misdemeanor, which can escalate to a Class B misdemeanor depending on aggravating factors. Larger amounts carry escalating penalties. Selling cannabis without a license is a separate criminal offense.

Growing hemp without a DDA license is also illegal under Delaware state law and exposes growers to state and federal liability.
