Cannabis plants are either male or female. Only female plants produce the buds (flowers) you're growing for. No — and the story behind that is important context. North Dakota voters approved home cultivation rights when they passed the Compassionate Care Act (Measure 5) in 2016 by 63.7% of the vote. The following year, the state legislature amended the law and stripped out those home grow rights before the program ever launched. Home cultivation has been illegal for everyone — recreational users and medical patients alike — ever since. Possession of grow equipment such as planters, grow tents, or lights with intent to cultivate is a separate Class A misdemeanor carrying up to 360 days in jail and a $3,000 fine. Not yet — but the trend line is notable. North Dakota has voted on adult-use legalization three times. Measure 5 in November 2024 was the closest vote yet: 47.45% in favor, 52.55% opposed, falling short by about five percentage points. The 2024 measure would have allowed possession of up to one ounce for adults 21 and older, home cultivation of up to three plants per person with a six-plant household cap, and a licensed retail market. Partially — and with an important catch. Possession of half an ounce or less is a criminal infraction carrying no jail time but a fine of up to $1,000 and a criminal record. North Dakota is one of the few states where "decriminalization" still results in a criminal record for a first offense. A bill to reduce that to a non-criminal $150 civil fine (HB 1596) passed the House 76-17 in February 2025 but was killed by the Senate 33-13 in April 2025. Possession of more than half an ounce is a misdemeanor carrying up to 30 days in jail and a $1,500 fine.
Yes. North Dakota's medical cannabis program has been active since 2019 after voters approved the Compassionate Care Act in 2016. Qualifying patients with debilitating conditions including cancer, PTSD, ALS, epilepsy, hepatitis C, and severe pain can register with the North Dakota Division of Medical Marijuana and purchase from licensed compassionate care dispensaries. Registered patients can purchase and possess up to 7.5 ounces within any 30-day period. As of August 1, 2025, edible products are also available for registered patients. Yes, with a hemp grower license from the North Dakota Department of Agriculture (NDDA). Applications are submitted by mail to the NDDA Plant Industries Division in Bismarck on a rolling basis year-round. One important requirement: you must have a license in hand before acquiring seeds, clones, or any propagative material — this is explicitly stated in the NDDA program rules and is stricter than many other state programs. Background check fee: $41.25 non-refundable — the only upfront cost before approval.

Grower license fee: Per-lot, not per-acre. A lot is a contiguous area containing the same variety throughout. This means a grower with one large single-variety field pays the same lot fee regardless of how many acres it covers — a significant advantage for large operations. Inspection and sampling fee: Approximately $125 per lot for inspection, sampling, and testing.
North Dakota spans USDA zones 3a through 5a — one of the coldest ranges for any state in this series. The northern tier near the Canadian border falls in zones 3a and 3b. The south-central and southeastern parts of the state including the Fargo area reach zones 4b and 5a. The outdoor growing season runs from late May through September in most of the state, with roughly 110 to 130 frost-free days.
